By using eterbyjamesmenendez.com or buying from or booking Éter by James Menendez, you agree to these terms.

Services and products

Éter provides restaurant consulting, private dining, meal preparation and meal kits, and digital sheets and templates. Consulting and dining services are arranged by conversation, and their scope, timing and price are set in a written proposal, invoice or booking confirmation.

Digital products

Sheets, workbooks and packs are digital files delivered by email, usually within one business day of payment. They are for use in your own business or household. You may not resell, share, publish or redistribute them. Digital products are non-refundable once delivered, because they cannot be returned. If a file is damaged or does not open, email me and I will fix it or replace it.

No guarantee of results

Results depend on your business, your team and your market. Examples and testimonials describe individual experiences and are not guarantees. I do not provide legal, tax, accounting or health advice.

Payments, deposits and cancellations

Fees are due as stated on the invoice or proposal. Private dinners and meal programs require a deposit of 50 percent to hold a date. Deposits are non-refundable, but can be applied to a new date if you reschedule at least 14 days before the event. If you cancel less than 14 days before an event, the deposit is kept. If I must cancel for illness or emergency, I will offer a new date or refund what you paid for the missed service.

Food safety and allergies

You must tell me about all allergies and dietary restrictions before service. I take care to prepare food safely, but I cannot guarantee that any food is free of allergens, because ingredients and kitchens carry a risk of cross-contact. You are responsible for informing your guests.

Confidentiality

I treat your business information, recipes, costs and financials as confidential and use them only to do the work for you.

Limitation of liability

To the extent allowed by law, my liability for any claim about the site, products or services is limited to the amount you paid me for the item at issue. I am not liable for indirect or consequential damages.

Website use and governing law

The site is provided as is, and content is for general information. Do not copy photos, text or branding without permission. These terms are governed by the laws of the State of Illinois.
